TERMS & CONDITIONS

 

• This agreement, and any addendums attached, constitutes the entire agreement between the parties. All terms and conditions of this agreement shall be binding on the heirs, agents and assigns of owner and Red Barn Kennels. This Client Agreement is governed by and construed in accordance with the local and state laws of Iowa. Each party fully consents to the laws of Iowa and prior to any legal filings will mediate in good faith to resolve disputes. 

 

• Owner will pay all costs and charges for special services requested and provide updated vaccination records from your vet before boarding date. Owner represents that the pet has not been exposed to rabies or distemper within 30 days prior to boarding.  

 

• Red Barn Boarding will provide food for the stay. Owners may want to bring special food for their dog(s) if there are special dietary needs.

• Red Barn Kennels will administer insulin shots for diabetic dogs.  

 

• Client hereby certifies that pet being boarded is not currently or in the foreseen future a show dog or source of income to pet owner. It is expressly agreed by Owner and Red Barn Kennels that Red Barn Kennels’ liability in no event exceeds the lesser of the current chattel value of a pet of the same species or the sum of $500.00, whichever is less.  

  

• Owner specifically represents that they are the lawful and valid owner of the pet, free and clear of all liens and encumbrances. 

 

• If the pet (in any form) becomes ill or if the state of the animal’s health otherwise requires attention, Red Barn Kennel at its sole discretion, is authorized to engage the services of the veterinarian provided in this Contract. If listed veterinarian is unavailable, Red Barn Kennel has the right to provide in-house veterinary services or arrange vet services for the animal at a minimum of $200 up to an amount specified by the pet owner at their own expense. 

 

• Owner agrees that in the event the boarding charges are not paid when due in accordance with this agreement, Red Barn Kennels may exercise its lawful rights upon ten (10) days written notice by delivering such notice via first-class mail to Owner’s Address. If for any reason the dog(s) is not going to be picked up on the scheduled dismissal date, Owner shall contact Red Barn Kennels to make arrangements to extend the animal's stay and will pay the additional charges based upon the aforesaid daily rate. 

 

• A pet that is unclaimed at Red Barn Kennels for ten (10) days beyond its scheduled discharge date is considered abandoned and will become the property of Red Barn Kennels. Every effort will be made to contact Owner/emergency contact if abandonment becomes an issue. 

 

• Owner will disclose any known incidents of aggression prior to boarding. Owner will be held solely responsible for any and all acts or behavior including aggression that takes place during boarding. 

 

• Owner agrees to release, indemnify, and hold harmless Red Barn Kennels from any and all manner of damages, claims, loss, liabilities, costs or expenses, including reasonable attorney’s fees and related costs, arising out of or related to Red Barn Kennels’ services, except which may arise from the gross negligence or intentional and willful misconduct of Red Barn Kennels, including, without limitation, (i.) any inaccuracy in any statement made by yourself or information provided by you to Red Barn Kennels (ii.) your dog, including but not limited to destruction of property, dog bites, injury, and transmission of disease, and (iii.) any action by yourself which is in breach of the terms and conditions of this agreement. 

 

• Force Majeure. Neither Owner nor Red Barn Kennels shall be responsible for failure or delay in performing its duties under this Agreement if such failure or delay is due to tornados, thunderstorms, fire, floods, snow storm, drought, riot, war or other acts of nature. 

 

• Cancellation Policy: If we receive a cancellation within 48 hours of the scheduled boarding date we charge a $25 cancellation fee. This will only be enforced in the event that Red Barn Kennels is booked to capacity.  

 

• Words “you” and “your” refers to the Owner. Conversely, “We” and “our” refers to Red Barn Kennels.  Owner and Red Barn Kennels may collectively be referred to as “the parties”, and singularly as a “party”. Entire Agreement. This agreement, and any addendums attached, constitutes the entire agreement between the parties. All terms and conditions of this agreement shall be binding on the heirs, agents and assigns of Owner and Red Barn Kennels.
